Terms and Conditions

1. Product Selection and Pricing

• Upgrade Products: Upgrade products are subject to an additional charge, determined at the builder's discretion.
• Changes After Selection: Any changes made to the selections after submission will be subject to an additional charge.
• Product Availability: Selections are subject to product availability. The builder will make every effort to fulfill the chosen items, but substitutions may be necessary if products are unavailable.
• Custom Goods: Any specific or custom goods selected are not replaceable. If a client wishes to change a custom item after selection, they will be responsible for the full cost of the change, including any delivery fees.

2. Pre-Start Consultation

• Initial Consultation: The pre-start consultation includes an initial three hours of pre-booked meeting time.
• Additional Consultation Time: Additional consultation time beyond the initial three hours may be subject to an additional charge, determined at the builder's discretion.

3. Cancellation Policy

• Cancellation Prior to Selection: If a client cancels their pre-start selection prior to submitting their choices, they will receive a full refund of any fees paid.
• Cancellation After Selection: If a client cancels their pre-start selection after submitting their choices, they will be subject to a cancellation fee, determined at the builder's discretion. This fee may cover any non-refundable expenses incurred by the builder in preparation for the project.
• Project Commencement: Once the project has commenced, no refunds will be issued for cancellations.

4. Dispute Resolution

• Negotiation: In the event of a dispute, the parties will first attempt to resolve the matter through good faith negotiation.
• Mediation: If negotiation fails, the parties will agree to participate in mediation with a qualified mediator. The costs of mediation will be shared equally by the parties.
• Legal Action: If mediation fails to resolve the dispute, either party may pursue legal action in accordance with the laws of Western Australia.

5. Legal Clauses

• WA Building Act 2011: This agreement is governed by the Building Act 2011 (WA) and any applicable regulations.
• WA Consumer Protection Act 1999: The client acknowledges and agrees that the builder is subject to the provisions of the Consumer Protection Act 1999 (WA) in relation to the supply of goods and services.
• Builder's Licence: The builder is a licensed builder in Western Australia and holds a current builder's licence as required by the Building Act 2011 (WA).

6. General Terms

• Builder's Right to Modify: The builder reserves the right to modify the selection process or terms and conditions at any time, providing reasonable notice to the client.
• Communication: It is the client's responsibility to ensure clear and timely communication with the builder regarding any questions, concerns, or changes related to the selections.
• Agreement: This pre-start selection agreement is a legally binding document. By submitting this document, the client acknowledges and agrees to all terms and conditions outlined herein.
